Orange County DUI Arrests: An Overview

Joe is driving down a city street in Newport Beach, California. He is swerving slightly and is driving too slowly. A police officer notices this behavior and pulls Joe over. The officer then approaches the vehicle and makes note of whether Joe’s speech is slurred, if he has bloodshot eyes and whether he smells of alcohol. The officer asks Joe to exit the vehicle and begins having him perform one or more field sobriety tests. Joe is unable to perform the tests well, according to the officer’s judgment. As a result, the police officer then arrests Joe for driving under the influence. At this time, the officer takes Joe’s driver’s license and gives him a “notice of suspension” (a temporary 30-day license). Upon arriving at the police station, Joe is asked to partake in a breath test or blood test to determine his blood alcohol concentration.
